or Licenses in Indonesia


Recordal of Trademark Assignment


The Required Documents for Recordal of Assignment/Merger

For recording an assignment:
  1. A Deed of Assignment that is notarized and legalized at the Indonesian Consulate;
  2. A Power of Attorney and a Statement of Intention to Use, both are simply signed on behalf of the Assignee.

Note:
  • Registration that consists of the identical or similar mark and covering similar goods are associated and should be recorded simultaneously.

For recording a Merger:
  1. A Deed of Merger that is notarized and legalized at the Indonesian Consulate;
  2. A Power of Attorney and a Statement of Intention to Use, both are simply signed on behalf of by the Assignee (the surviving company).

Note:
  • All Trademark Registration in the name of the same should be recorded simultaneously.


Recordal of Patent Assignment


The Presidential Decree No.37 of 2010 encompasses the following situations involving transfers of patents:

a. inheritance; 
b. gift; 
c. will; 
d. written agreement; or 
e. Other reason justified by the laws and regulations.

Assignments and merger agreements are covered by “written agreement”.  

Formality requirements to record a patent assignment are as follows:
  1. Power of Attorney signed by the Assignee (no notarization required);
  2. Original or certified true copy of the assignment document or agreement (commonly short form agreements are in fact used);
  3. Evidence of payment of the annuity up to the current year; and
  4. Copy of certificate of patent registration.

Where the recordal process is completed, the Patent Office will issue as follows:

a.  A letter of notification of the change in proprietor.
b.  A notification in the patent gazette of the change in proprietor.
