PROTECTION OPTIONS

THE INTERNATIONAL ROUTE (via The Madrid System)

To use WIPO’s Madrid System (The Madrid Route) for registrations in member countries of Madrid Protocol.

The Madrid System, WIPO’s international trademark system, currently includes 115 members representing 131 countries, covering more than 80% of global trade. Its membership continues to expand as more jurisdictions recognize the advantages of the system.
Indonesian businesses, nationals, or those with a domicile or commercial presence in Indonesia, who have filed or registered a "basic mark" in Indonesia, may apply for international protection of their trademark in any or all of the 130 other member countries simultaneously.
As new countries accede to the Madrid System, holders of existing international trademark registrations can easily extend protection to additional jurisdictions. ​

The direct national route requires brand owners to file directly with each country’s trademark office where protection is sought. This approach allows applications to be tailored to local rules and practices. For example, the designation of goods and services,  variations can be made for each jurisdiction. By having experienced local representatives, applicants can minimize the risk of objections or official actions,  saving time and costs in the long run.

Direct filings are often more practical if protection is sought in only a few countries, as the cost advantages of using the Madrid System become less significant in such cases. They also serve as the primary option for filing in jurisdictions that are not members of the Madrid System.

In addition, direct foreign filings are advisable when there is a higher risk that your home trademark application may lapse or fail to proceed to registration.

THE DIRECT REGIONAL ROUTE

One application is filed with an intergovernmental organization in the region where protection is sought.

A single application can be filed with certain intergovernmental organizations to obtain protection across multiple member states within a region, such as:​

• European Union Intellectual Property Office (EUIPO) – provides protection in all 27 EU member states through the European Union Trade Mark (EUTM) system.
• African Regional Intellectual Property Organization (ARIPO) – covers multiple English-speaking African member states under the Banjul Protocol.
• Organisation Africaine de la Propriété Intellectuelle (OAPI) – covers 17 French-speaking African countries through a single filing.
• Benelux Office for Intellectual Property (BOIP) – grants protection across Belgium, the Netherlands, and Luxembourg with one application.

Through these systems, trademark owners can obtain unified protection across all member countries with a single submission. For instance, a company seeking protection in France, Germany, Italy, and Spain can secure coverage in those countries — along with the rest of the EU — by filing one EUTM application. Similarly, filings via ARIPO, OAPI, or BOIP extend protection across all their respective member states. These regional systems streamline the process by centralizing filing, examination, and registration, ensuring consistent protection in multiple jurisdictions.
